Hereinafter referred to as "we/us". Customers are hereinafter referred to as "customers".
Scope
These General Terms and Conditions (GTC) apply to all orders, deliveries and services concluded via our online shop otres.ch. Any deviating or supplementary terms of the customer shall not apply, even if we do not expressly object to them. The version of these GTC published in the shop at the time of the order is decisive.
Contract Language and Communication
The contract language is German, unless expressly specified otherwise during checkout. Legally relevant communications (in particular defect notices, return requests and contract-related communications) must be addressed in text form to info@otres.ch.
Offer, Product Presentation and Conclusion of Contract
The presentation of products, prices and availability in the online shop does not constitute a legally binding offer, but a non-binding invitation to order. A contract is only concluded once we confirm the order (e.g. by email) or ship the goods. We are entitled to refuse or cancel orders if there are concrete indications of misuse, fraud, incorrect information or unusual ordering patterns. Errors in writing, printing, pricing and calculation, as well as technical errors, are reserved.
Range of Products (in particular Clothing / Textiles)
We sell via otres.ch in particular clothing and textile-related products (e.g. long sleeves, shirts, accessories). The specific scope of goods and services results from the respective product description in the shop at the time of the order.
Note on future offerings: Should an "otres" membership or digital services be offered at a later date, these will be described separately and an updated version of these GTC may apply. For orders already placed, the version of the GTC valid at the time of order remains applicable.
Sizes, Fit, Material Information and Care Instructions
Size information, size charts and fit notes are provided for guidance only. Depending on cut, production and material, minor deviations may occur. Care and material instructions must be observed. Damage or changes resulting from improper care (e.g. incorrect washing temperature, tumble drying, incorrect ironing, aggressive cleaning agents) do not constitute a defect.
Product Images and Reasonable Deviations
Product images serve as illustrations. Deviations in colour and appearance due to screen/lighting conditions are possible. Material- and production-related deviations customary in the industry (e.g. minimal tolerances in dimensions, colour, print position, textile structure) generally do not constitute a defect, provided the fitness for use is not materially impaired.
Prices, Currency and Shipping Costs
The prices displayed at checkout in CHF apply. Whether prices are shown including or excluding VAT results from the price display in the shop/checkout. Shipping costs and any surcharges are shown separately at checkout and are to be borne by the customer, unless expressly stated otherwise. Shipping costs CHF 9.50.
Payment, Due Date and Security Checks
The payment methods offered at checkout are available to the customer depending on the order. Payment is generally due immediately, unless a payment term has been expressly agreed. We may withhold orders until payment has been received in full. To prevent misuse, we may verify or refuse orders where objectively justified.
Retention of Title
The goods remain our property until all claims arising from the purchase contract have been paid in full.
Delivery Area (Switzerland)
We deliver exclusively to delivery addresses within Switzerland. Deliveries to other countries are excluded, unless expressly agreed otherwise in writing in the shop.
Delivery Address and Duties to Cooperate
The customer is obliged to provide a correct and complete delivery address. Subsequent changes of address are only possible as long as the order has not yet been shipped; we are entitled to charge the additional effort and any additional costs incurred as a result. The customer must ensure that delivery to the address provided is possible (e.g. correct name on the address, accessibility, readiness to receive, ability to collect in the case of branch delivery).
Shipping (Swiss Post)
Shipping is generally carried out by Swiss Post. The specific shipping method depends on the product, package size, risk and operational requirements; there is no entitlement to a specific shipping method unless expressly and bindingly selected or guaranteed at checkout. Tracking information, where available, is transmitted electronically or displayed in the customer account.
Processing Time and Delivery Periods
Delivery time is usually approximately 1–3 business days, however without guarantee. Information on delivery times is – unless expressly guaranteed as binding – a non-binding estimate. Delays may arise in particular due to production capacity, suppliers, seasonal peaks, operational processes of Swiss Post, weather events or force majeure. No claims for damages arise from delivery delays, to the extent permitted by law. We are entitled to make partial deliveries where reasonable for the customer.
Preorder / Presale (Drops, Preorders)
Individual items may be offered as preorders ("Preorder"). In this case, these are products that are not (or not in sufficient quantity) in stock at the time of order and that are first produced, procured or prepared for shipment after the order is received. For preorder items, the estimated delivery period is shown in the shop/checkout. This information constitutes an estimate unless expressly guaranteed as binding. Delays may occur with preorders in particular due to production, quality controls, suppliers, transport or force majeure. We may cancel preorder orders in whole or in part for objective reasons (e.g. production failure, missing/faulty delivery from suppliers, quality defects in production, unforeseeable supply chain disruptions, quota or material shortages). In this case, we will refund amounts already paid for items that cannot be delivered. Further claims (in particular damages, compensation for consequential damages or loss of profit) are – to the extent permitted by law – excluded. If an order contains both in-stock items and preorder items, we are entitled to ship the order together once all items are available, or to make partial deliveries. Any additional costs will only be charged to the customer if this is transparently disclosed at checkout or agreed in advance. Cancellation by the customer is only possible for preorders as long as the order has not yet entered processing/production/picking. Once production/order processing has begun, there is no entitlement to cancellation. We may charge the customer for expenses already incurred, to the extent permitted by law.
Pre-Orders and Delivery Times
Products marked as “Pre-Order” are items that are not yet, or not fully, available at the time the order is placed. Any production, availability, shipping, or delivery time stated on our website is an estimated timeframe only and does not constitute a guaranteed or binding delivery date, to the extent permitted by applicable law.
Delays may occur due to production, transportation, customs clearance, suppliers, or other circumstances beyond OTRES’ reasonable control. To the extent permitted by applicable law, OTRES shall not be liable for damages resulting solely from such delivery delays. Any mandatory statutory rights of the customer remain unaffected.
If an order contains both in-stock items and Pre-Order items, no partial shipments will be made. The entire order will be shipped together once all items included in the order are available. Therefore, the delivery time of the entire order will depend on the item with the longest availability or delivery timeframe.
By placing an order containing a Pre-Order item, the customer acknowledges and accepts that delivery may take longer than initially estimated and agrees to the conditions stated above.
Delivery Obstacles, Non-Collection and Refusal of Acceptance
If a shipment is not delivered due to incorrect information, non-collection or refusal of acceptance and is returned to us, we are entitled to charge the customer for the additional costs incurred as a result (return shipment, storage, re-shipment, processing) or to offset them against any refund. In such cases, a refund will be made, if at all, less the costs actually incurred.
Transport Damage
The customer should, where possible, identify and document (photos of the package, label and contents) any visible transport damage or damaged packages immediately upon receipt and inform us within 48 hours of delivery. Mandatory statutory rights remain unaffected.
Duty to Inspect, Notice of Defects and Warranty
The customer must inspect the goods as soon as reasonably possible after receipt. Obvious defects, incorrect deliveries or missing quantities must be reported in text form within 7 days of receipt (including description and photos). Hidden defects must be reported immediately upon discovery. In the case of a justified defect, we will, at our discretion, provide repair, replacement delivery or a credit note/price reduction. If repair or replacement delivery fails or is disproportionate, we may, at our discretion, grant an appropriate price reduction or reverse the purchase. Excluded from the warranty are damages or impairments resulting from improper use, incorrect handling, improper care, normal wear and tear, or interventions/modifications by the customer or third parties. Minor deviations in colour/structure/dimensions/print position that are customary in the industry do not constitute a defect, provided the fitness for use is not materially impaired.
Returns and exchanges
Returns and exchanges are excluded unless there is a demonstrably incorrect delivery or a defect we have acknowledged. Complaints must be reported in text form to info@otres.ch within 7 days of receipt (incl. description and photos). In the event of a justified complaint, we will, at our discretion, provide a remedy, replacement delivery or credit note/price reduction. Unless otherwise agreed in writing, returns must be sent to the following address: OTRES, Prime Retail GmbH, Bernstrasse 18, 2555 Brügg BE, Switzerland (exclusively a return address, as this is where our warehouse is located). Return shipping costs are generally borne by the customer unless expressly agreed otherwise.
Cancellations by the Customer
Cancellation is only possible as long as the order has not yet been processed/picked/shipped. Once processing has begun, there is no entitlement to cancellation. We may charge the customer for expenses already incurred, to the extent permitted by law.
Impermissible Use and Misuse
The customer undertakes to make lawful use of our products and services. We may refuse or cancel orders or block customer accounts if there are concrete indications of misuse, fraud or unlawful purposes.
Liability
We are liable within the scope of applicable law for damages caused intentionally or by gross negligence. Liability for slight negligence is – to the extent permitted by law – excluded. Also excluded – to the extent permitted by law – is liability for indirect damages, consequential damages, loss of profit, loss of use, and third-party claims. Mandatory liability under applicable law remains reserved. To the extent a limitation of liability is legally permissible, our liability for slight negligence is limited to the amount paid by the customer for the specific order concerned.
Force Majeure
Events beyond our control (e.g. natural events, strikes, official measures, significant transport/supply chain disruptions) are considered force majeure. In such cases, we are released from our performance obligations for the duration and to the extent of the disruption. Claims for damages are – to the extent permitted by law – excluded. In the case of definitive impossibility, we will refund payments already made for goods not delivered, to the extent no delivery has taken place.
Intellectual Property
All content of the shop (texts, images, logos, layout, design, trademarks) is protected. Any use beyond the intended purchase and private use requires our prior written consent.
Data Protection
Personal data is processed in accordance with our Privacy Policy . This forms an integral part of the contractual relationship.
Changes to the GTC
We may amend these GTC at any time. The version published in the shop at the time of the order shall apply. Orders already placed remain unaffected.
Severability
Should any provision of these GTC be or become invalid or unenforceable in whole or in part, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, a legally permissible arrangement shall be deemed agreed that comes closest to the economic purpose intended.
Applicable Law and Jurisdiction
Unless mandatory law provides otherwise, Swiss law applies. The place of jurisdiction is – to the extent permissible – our registered office. Mandatory statutory places of jurisdiction remain reserved for consumers.
